What Happened Inside Poetica Coffee
Rep. Dan Goldman, a Democratic congressman from New York’s 10th District and an outspoken supporter of Israel, stopped at Poetica Coffee in Brooklyn with his young daughter for a simple drink order.[4] Staff served him at the time, and he paid around $9.82, according to later reports.[2] Afterward, the café posted a photo of Goldman at the counter on social media, announced it had issued him a refund, and told him not to come back because of his views on Israel and the Gaza war.[2]
In the now-deleted post, Poetica said, “Here at Poetica, we don’t serve racists, fascists, homophobes, genocide enablers, or anyone in between,” and added that it would have turned Goldman away if staff had recognized him.[2][3] The post claimed the café did not need his money and suggested it “probably” came from the pro-Israel lobby, citing the American Israel Public Affairs Committee, known as AIPAC.[2] The message ended by telling Goldman to “enjoy your loss on Tuesday” and to never come back to the shop.[2]

From Social-Media Flex to Federal Investigation
After the post spread, Poetica faced a fast wave of anger and support online, along with one-star review campaigns and calls for boycotts.[1][5] The shop pulled down the Facebook or Instagram post and at least one account went dark, limiting its ability to explain or defend what happened.[3][5] A staffer reached by a reporter said only, “No comment. We stand against genocide,” underscoring that the café saw the move as a moral stand, not a customer-service mistake.[2]
The Department of Justice’s Civil Rights Division, led by Assistant Attorney General Harmeet Dhillon under President Trump, announced it was opening an investigation.[2][3] Dhillon wrote that federal law bars public places such as coffee shops from discriminating based on race, religion, or national origin, and said the “denial of service taunts” directed at Goldman could be both “despicable” and unlawful if tied to his Jewish identity or perceived national origin.[3][4] She warned that enforcement action is possible if the probe confirms discrimination.[3]
Is This Free Speech or Illegal Discrimination?
Legal experts have long noted that federal law does not clearly protect people from being refused service only because of their political views, even though many Americans see that as unfair.[10] At the same time, public-accommodations laws do protect customers from bias based on who they are, not what they think—things like race, religion, and national origin.[3][10] The key question in the Poetica case is whether the café targeted Goldman for his policy stance or for being a Jewish supporter of Israel, which could cross into religious or ethnic discrimination.[3]
Poetica’s own mission language, highlighted by critics, promises a café “where the door doesn’t close on anyone,” which clashes sharply with banning a customer over his views on a foreign conflict.[3][5] Local Jewish leaders argued the shop’s message and refund violated New York human-rights rules that bar discrimination in public businesses, especially against Jewish patrons.[3][5] At the same time, Goldman’s voting record shows he has backed both Israel’s security and more aid and protection for Palestinian civilians, which cuts against the “genocide enabler” label even if many progressives still criticize his refusal to condition military aid.[9]
When Everyday Businesses Become Political Weapons
This fight fits a broader pattern where stores, restaurants, and coffee shops turn customer service into political tests, from the Red Hen asking out a Trump press secretary in 2018 to bakeries refusing same-sex wedding cakes.[10] A Wharton analysis found that, unless courts change course, businesses often have legal room to refuse customers over politics, even if the public hates it.[10] Many Americans are worn out with constant political conflict, and polls show most do not want companies weighing in on hot-button issues at all.[11][14]

For people on both the right and the left, the Poetica story feeds a growing sense that powerful institutions are playing games while regular citizens pay the price. Conservatives see a “woke” shop proudly shaming a Jewish lawmaker in public.
